This TOU provides only a limited license to access and use the Site. Accordingly, you expressly acknowledge and agree that Metro transfers no ownership or intellectual property interest to or title in the Site to you or anyone else. You agree to defend, indemnify, and hold harmless Metro and its affiliates and all of their respective employees, agents, directors, officers, shareholders, attorneys, successors, and assigns from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees and litigation expenses) relating to or arising from any breach by you of this TOU.
This TOU makes up the entire agreement between Metro and you relating to the Site and replaces any prior understandings or agreements (whether oral or written) regarding the Site. The laws of the state of California, without regard to its conflict of law principles, will govern this TOU.
Metro may at any time revise this TOU by updating this posting. By using this web site, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current terms to which you are bound.
Consent and Opt-In. By providing your mobile phone number and opting in to SMS/text messaging from Nautilus International (“Nautilus,” “we,” “us,” or “our”), you expressly consent to receive recurring automated text messages related to the purpose for which you opted in, which may include but is not limited to: account notifications, service alerts, appointment reminders, security verification codes, and other transactional or informational messages. You may also receive promotional or marketing messages if you have separately opted in to receive them.
Consent to receive SMS/text messages is not a condition of purchase, employment, or any other service we provide. Message and data rates may apply. Message frequency varies based on your interaction with our services.

Supported Carriers. SMS messaging is supported on most major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
Privacy. Information collected through our SMS program is governed by our Privacy Policy. Your mobile number is collected solely for the purpose of sending the messages you have consented to receive. We do not use your mobile opt-in or phone number for any purpose beyond the scope of this SMS program unless you provide separate, explicit consent.
